Community Terms of Use

These Terms of Use (“Terms”) govern access to and use of a community platform made available within a mobile application published by a third party (the “Publisher”), and incorporating a technical solution provided by Octopus Community, a SAS registered under French law, with its registered office at 14 avenue du Général de Gaulle, 94160 Saint-Mandé, France (“Octopus Community” or the “Provider”).

By accessing this community platform (the “Platform”), you agree to be bound by these Terms. These Terms constitute a contract between you (“User”) and the Publisher. In these Terms, “we”, “us” and “our” refer to the Publisher. How your personal data is processed is explained in the Privacy Policy.

Octopus Community is not a party to these Terms. It acts solely as a technical service provider: it supplies the software solution that powers the Platform and operates it, including moderation, on the Publisher's behalf.

1. Eligibility

Use of the Platform is strictly limited to individuals who are at least 16 years old. By accessing the Platform or creating a user account, you declare and warrant that you are 16 years of age or older at the time of registration.

If you are under 16 years old, you are not permitted to use the Platform under any circumstances, even with the authorization or supervision of a legal representative.

Any false declaration regarding your age constitutes a violation of these Terms and may result in the immediate suspension or deletion of your account, without compensation.

We reserve the right to verify the declared age of any user by any reasonable means, including requesting proof of age, and to deny or terminate access to the Platform in case of doubt or non-compliance.

By using the Platform, you also confirm that you:

• have the legal capacity to enter into a contract;
• are not suspended, excluded, or banned from accessing the Platform due to prior violations of the Terms or Community Guidelines;
• will comply with all applicable laws and regulations governing your use of the Services.

Failure to meet these eligibility criteria may result in the termination of your account and, where applicable, notification to the relevant authorities if any offenses are identified.

2. Account Creation

To access certain features of the App, you may need to create a user account ("Account"). When creating an Account, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your information.
• Keep your login credentials confidential.
• Notify us immediately of any unauthorized use of your Account.

We reserve the right to suspend or terminate accounts with false or misleading information.

3. Services Description

The Platform allows you to connect with others and discuss topics that interest you. The key features include:

• Posts: Create discussions to engage with other users by sharing text and media. Users can react to or reply to posts. Each post is categorized within a specific “group” allowing content to be organized into distinct feeds.
• Groups: Explore all posts in one consolidated feed or filter posts by specific group. This allows you to focus on the content that matters most to you.
• Profile Page: To interact with the community, users create a profile. You may optionally choose a username, add a profile picture and a short description.

AI-assisted content. Some content in the community is created or suggested with the help of artificial intelligence and published under a profile controlled by the Publisher. Automated technologies are also used to moderate content; any suspension or ban of an account is decided by a person.

4. Your Use of the Services

The Platform is designed for you to express yourself and connect with other users. However, this should not be at the expense of the well-being and safety of others, or in violation of applicable laws or our Community Guidelines. There is no tolerance for objectionable content or abusive users.

You may not:

• Use the Platform in an illegal, fraudulent, dishonest, malicious or discriminatory manner, or in breach of applicable laws and regulations;
• Infringe the rights of others, in particular their intellectual property rights;
• Post content of a pornographic, discriminatory, racist, violent, defamatory or sexual nature, or content that may constitute bullying or intimidation. Photos of a pornographic, exhibitionist or indecent nature are formally prohibited and may lead to the deletion of the account from which they originated, without prejudice to any other remedies available to us or to criminal proceedings;
• Use the name, the voice or the image of any person without their permission;
• Share personal information about other people without their consent, or collect data or content belonging to other users;
• Post unsolicited commercial communications or send spam;
• Send harmful or disruptive code, or interfere with the security, integrity or availability of the Services, including by overloading, flooding, spamming or mail-bombing them;
• Modify the operation of the Services or inhibit access to them;
• Use automated means to collect information from the Services;
• Misuse our channels — reporting a user or content, contacting support, or appealing a moderation decision — for abusive, defamatory or fraudulent purposes.

You agree to read and comply with our Community Guidelines when using the Platform. We reserve the right to filter or delete content brought to our attention that we consider to be in violation of these Terms, the Community Guidelines or applicable laws. We can also suspend any User Account for conduct that breaches this Section, as set out in Section 10, and report unlawful content and activity to law enforcement.

You accept full responsibility for any action, content, information or data which you may upload, download, post, send, or keep within the scope of the use of the Platform. If you harm the Publisher or the Provider through the content you post, you will be required to compensate them for any damages, losses or expense caused by your words or actions.

When you delete content or your account, content that has been subject to a moderation decision, and the data needed to identify its author, may be kept for up to 12 months for safety reasons and to answer lawful requests from the authorities, as described in the Privacy Policy.

5. User Content

You keep all rights in the content you post, upload, or otherwise make available through the Platform ("User Content").

You grant the Publisher a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and distribute that content for the purpose of operating the community, and to make the technical adaptations necessary to display it, such as reformatting or translation. This licence lasts as long as the content remains published. The Publisher may sub-licence these rights to Octopus Community and to its providers, solely to the extent necessary to operate, secure and moderate the Platform on the Publisher's behalf. Neither the Publisher nor Octopus Community acquires any ownership of your content.

You warrant that you hold all rights necessary to post the content and that it infringes no third-party right or applicable law. You are solely responsible for any claim relating to the User Content you provide.

6. Intellectual Property

All intellectual property rights in the Platform, including but not limited to software, text, images, and trademarks, are owned by or licensed to Octopus Community. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.

7. Notifications and Reports

As a hosting provider and service provider, we are not under a general obligation to monitor the information and content stored on our platform.

However, we are strongly committed to enforcing our Community Guidelines to ensure the safety of everyone using the Platform. We actively work to address content and behavior that violate these guidelines.

To help us maintain a safe and respectful community, we encourage you to report any content or user account you believe is inappropriate. You can report content or users directly within the app by clicking on the icon next to a post, a message, or on a user's profile page and selecting ##INLINE0## Alternatively, you can contact us at contact@octopuscommunity.com.

When submitting a report, please include any relevant evidence or information to support your claim, as this helps us respond more efficiently.

All reports are reviewed diligently, and we aim to address them promptly. When appropriate, we will notify you of the action taken in response to your report or the reasons why no action was taken.

Please note that abusive or false use of our reporting channels may result in consequences, including suspension of your account, in accordance with these Terms and applicable laws.

8. Prevention and Fight Against the Exploitation and Sexual Abuse of Minors

We are firmly committed to preventing and combating any illegal content or behavior related to the exploitation and sexual abuse of minors. To this end, we implement the following measures:

• Reporting Mechanisms: Users have access to tools that are simple and easy to use for reporting any suspicious content or behavior, as detailed in Section 7. These reports are directed to dedicated moderation queues and are given priority by our team.
• Moderation and Collaboration with Authorities: We use moderation tools, including technologies that comply with the legal framework, to quickly detect and remove illegal content. When necessary, we work closely with competent authorities to report and share required information.
• Internal Awareness Policy: We provide regular training to our internal teams, particularly those responsible for content moderation, to ensure they can effectively detect, evaluate, and handle content related to the sexual abuse of minors.

These commitments reflect our absolute priority to ensure a safe and respectful online space, in compliance with children's fundamental rights and international standards.

9. Privacy

The Privacy Policy explains how your personal data is collected, used and protected.

10. Suspension and Termination

We may restrict or remove content, or suspend or terminate your account, where it breaches these Terms, the Community Guidelines or applicable law, or where a court or competent authority requires it.

Except where the law or an authority prevents it, or where doing so would compromise the safety of others, we tell you which measure has been taken, which content or conduct it concerns and on what ground.

You may contest the measure within six months by writing to contact@octopuscommunity.com. You will receive a reasoned reply. This does not affect your right to bring the matter before a court or a competent authority.

11. Limitation of Liability

To the fullest extent permitted by law, the Publisher and the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Platform; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles. This does not deprive you of the protection afforded by the mandatory provisions of the law of the country in which you habitually reside.

13. Changes to the Terms

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last update" date, and via in-app notifications. It is your responsibility to review the updated Terms, which will be available on this page. Continued use of the Services following the notification of changes constitutes your acceptance of the updated Terms.
