Community Terms of Use.

These Terms of Use (“Terms”) govern access to and use of a community platform made available within a mobile application published by a third party (the “Publisher”), and incorporating a technical solution provided by Octopus Community, a SAS registered under French law, with its registered office at 14 avenue du Général de Gaulle, 94160 Saint-Mandé, France (“Octopus Community”, the “Provider”, or the “Technical Provider”).
By accessing this community platform (the “Platform”), you agree to be bound by these Terms, which constitute a contract between you (“User”) and the Publisher, regarding your use of the Platform.
Octopus Community acts solely as a technical service provider, supplying the software solution that powers the Platform, without managing the content published or the interactions between users.
1. Acceptance of the Terms
Access to and use of the community platform (the “Platform”), integrated into a mobile application published by a third party (the “Publisher”) and operated using a technical solution provided by Octopus Community (the “Technical Provider”), are subject to these Terms of Use (the “Terms”). By accessing the Platform, you agree to comply with these Terms and the applicable Privacy Policy.
2. Eligibility
To sign up to the Platform, you must:
Have the legal capacity to enter into a binding agreement ;
Be at least 16 years old. If you are under the age of majority in your jurisdiction, you must have the consent of your parent or legal guardian;
Not have been previously suspended or removed from the Services for violation of these Terms or our Community Guidelines;
Comply with all applicable laws and regulations.
The Publisher or the Provider (“We”, “us”) may take reasonable steps to ensure that these rules are respected. If we have any evidence or serious reason to suspect that you do not comply with these provisions, we can suspend your account and take any action we deem necessary to prevent you from accessing the Platform.
3. Account Creation
To access certain features of the App, you may need to create a user account ("Account"). When creating an Account, you agree to:
Provide accurate, current, and complete information.
Maintain and promptly update your information.
Keep your login credentials confidential.
Notify us immediately of any unauthorized use of your Account.
We reserve the right to suspend or terminate accounts with false or misleading information.
4. Services Description
The Platform allows you to connect with others and discuss topics that interest you. The key features include:
Posts: Create discussions to engage with other users by sharing text and optional images. Users can react to or reply to posts. Each post is categorized within a specific “group” allowing content to be organized into distinct feeds.
Groups: Explore all posts in one consolidated feed or filter posts by specific group. This allows you to focus on the content that matters most to you.
Profile Page: To interact with the community, users must sign up and create a profile with a username. Optionally, you can add a profile picture and a short description.
5. User Conduct
There is no tolerance for objectionable content or abusive users. You agree not to engage in any of the following prohibited activities:
Violating any applicable laws or regulations.
Infringing upon the rights of others.
Transmitting any harmful or disruptive code.
Engaging in any activity that could damage, disable, or impair the Services.
Interacting with the community without respecting the Community Guidelines.
6. User Content
You retain ownership of any content you post, upload, or otherwise make available through the Platform ("User Content").
By posting User Content, you represent and warrant that you own or have the necessary rights to use and share the content and that it does not infringe any third-party rights or violate any applicable laws or regulations. You agree that you are solely responsible for any claims related to the User Content you provide.
By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Services.
7. Intellectual Property
All intellectual property rights in the Platform, including but not limited to software, text, images, and trademarks, are owned by or licensed to Octopus Community. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.
8. Your Use of the Services
The Platform is designed for you to express yourself and connect with other users. However, this should not be at the expense of the well-being and safety of others, and/or in violation of applicable laws or our Community Guidelines.
You agree to comply with all applicable laws and regulations when you use the Platform.
You may not do any of the following while accessing or using the Platform:
Post unsolicited commercial communications or send spam;
Collect information, data, or content belonging to other users without their consent;
Post content or broadcast any message or content that infringes on the rights of third parties (in particular their intellectual property rights), or that is of a pornographic, discriminatory, racist, violent, defamatory, or sexual nature, and/or which may constitute bullying or intimidation of other persons. To this end, we remind you that any photos of a pornographic, exhibitionist or indecent nature are formally prohibited. Any publication of this nature constitutes an offence liable to deletion of the user account from which they originated, without prejudice to any other remedies available to us or criminal proceedings which may arise from such postings;
Use the name, the voice or the image of any person without their permission;
Modify the operation of the Services or inhibit access to them;
Misuse our channels (including for reporting a user or a content, contacting support, appealing a moderation decision) for abusive, defamatory or fraudulent purposes;
Interfere with any security measures protecting the Services or disrupt (or attempt to disrupt) access to the Services by any means including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Services;
Use automated means to collect information from Services;
Use the Platform in an illegal, fraudulent, dishonest, malicious and/or discriminatory manner.
You agree to read and comply with our Community Guidelines when using the Platform. We reserve the right to filter or delete content brought to our attention that we consider to be in violation with these Terms, the Community Guidelines and/or applicable laws. We can also suspend any User Account for conduct that breaches this Section (as detailed in Section 9) and report some unlawful content and activity to law enforcement.
You accept full responsibility for any action, content, information or data which you may upload, download, post, send, or keep within the scope of the use of the Platform. If you harm the Publisher or the Provider through the content you post, you will be required to compensate them for any damages, losses or expense caused by your words or actions.
For reasons of security and public order, we may keep, for a reasonable period in compliance with applicable regulations or until the request of deletion provided by the user, a copy of content shared by the user, even where the user may have deleted their account or where said content may have been deleted from the Services.
9. Notifications and Reports
As a hosting provider and service provider, we are not under a general obligation to monitor the information and content stored on our platform.
However, we are strongly committed to enforcing our Community Guidelines to ensure the safety of everyone using the Platform. We actively work to address content and behavior that violate these guidelines, particularly content or conduct deemed inappropriate.
To help us maintain a safe and respectful community, we encourage you to report any content or user account you believe is inappropriate.
You can report content or users directly within the app by clicking on the icon next to a post, message, or on a user’s profile page and selecting “Report.” Alternatively, you can contact us at contact@octopuscommunity.com.
When submitting a report, please include any relevant evidence or information to support your claim, as this helps us respond more efficiently.
All reports are reviewed diligently, and we aim to address them promptly. When appropriate, we will notify you of the action taken in response to your report or the reasons why no action was taken.
Please note that abusive or false use of our reporting channels may result in consequences, including suspension of your account, in accordance with these Terms and applicable laws.
10. Prevention and Fight Against the Exploitation and Sexual Abuse of Minors
As specified in section 2, the Platform is intended for users aged 16 and above.
However, we are firmly committed to preventing and combating any illegal content or behavior related to the exploitation and sexual abuse of minors. To this end, we implement the following measures:
Reporting Mechanisms: Users have access to tools that are simple and easy to use for reporting any suspicious content or behavior, as detailed in section 9. These reports are directed to dedicated moderation queues and are given priority by our team.
Moderation and Collaboration with Authorities: We use moderation tools, including technologies that comply with the legal framework, to quickly detect and remove illegal content. When necessary, we work closely with competent authorities to report and share required information.
Internal Awareness Policy: We provide regular training to our internal teams, particularly those responsible for content moderation, to ensure they can effectively detect, evaluate, and handle content related to the sexual abuse of minors.

11. Privacy
Your privacy is important to us. Please review the Privacy Policy to understand how we collect, use, and protect your personal information.
The Privacy Policy forms an integral part of these Terms. By agreeing to these Terms, you also agree to the terms outlined in our Privacy Policy. If you do not agree with any aspect of the Policy, you must not use the Platform.
12. Termination
We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or third parties, or for any other reason.
13. Limitation of Liability
To the fullest extent permitted by law, the Publisher and the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Platform; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
15. Changes to the Terms
We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date, and via in-app notifications. It is your responsibility to review the updated Terms, which will be available on this page. Continued use of the Services following the notification of changes constitutes your acceptance of the updated Terms.
